A "Jansabha" & "Sadbuddhi yagya" was organized on 19th Sept 2010 in Kanjhawla demanding the government to stop acquisition of agricultural land and make proper amendments in the Land Acquisitions Act of 1984.

 

 

The details of the discussions and the opinions expressed by various farmer leaders, social activists and other farmers during the meeting are presented in the report below.

 

 

Kanjhawla farmers's dharna for denotification of agricultural land which commenced on 19th march 2008 has completed 31 months. To mark the beginning of 32 month of the dharna a "Jansabha" and  "Sadbuddhi yagya"  was organized on 19th Sept 2010 in Kanjhawla demanding from the government to stop acquisition of agricultural land and make proper amendments in the Land Acquisitions Act of 1894. Farmers leaders from NCR region of the ongoing struggle in UP Aligarh,Dadri power project district Ghaziabad, Haryana district Jajjar and Sonipat as well as farmers of the Khanjahawla struggle and social activists gathered to discuss on the amendments to be made on Land Acquistion Act of 1894.

 

 The basic question that emerges is "What kind of amendment should be made in the the ACT after 63 years of independence", whether it should be in favor of Corporations or towards the "Welfare of the Farmers". This questions also arises due to the fact that once a person elected into National or Sate legislations  for just a span of  only 5 yrs, it ensures the future of their coming generations in politics. On one hand it's a charming feature of our democracy that along with the First Prime minister of India Pt Jawaharlal Nehru and their present generation of Smt Sonia Gandhi, Smt Menka Gandhi and their sons Rahul Gandhi and Varun Gandhi have a secured future in the Country's political representation similarly the Business houses and  Business Corporation have a secured future for generations and on the oher hand it's a matter of misfortune that centuries old generations of farmers who are dependent on agriculture and feeding the mankind, also the pillars of human sustenance in the country and of the world are severely impacted as soon as a development scheme is approved because it makes farmers landless. This keeps on continuing till date. Existence of such actions cannot be part of a heathy democracy.

 

During the assembly the meeting convener of Jan Sangarsh Vahini and Bhumi Bachao Andolan Bhupendra Singh Rawat said that the way in which govternment  land grabbing agencies like Delhi Development Authority( DDA), the neighboring New Okhla Industrial Development Authority(NOIDA) Haryana urban development Agency (HUDA ), Ghaziabad Development Authority (GDA) and many such other which are spread across the country grab land in the name of  development for SEZ, Express Highways, Large Dams, Costal management zones are eventually turning farmers landless. If demands are raised for rehabilitation to provide land in lieu of land  the government is not capable to meet those demands. Will centuries of farmers dependent on agriculture are solely responsible to make sacrifices for development and turn landless. The time has come after 63 yrs of independence we need to put an end to such practices. And so, the very next question arises is "Is it so difficult to make schemes in such a manner which are aimed towards the benefits and welfare of the farmers"?

 

To ensure this a concept note of "Farmer-Government Partnership" has been prepared with minor change in the Land Acquistion Act of 1894 under which,

 

The first demand which the farmers can make is that the Gram Sabhas of the village should be consulted on the desirability of acquisition under section – 4.  This would enable the whole village to deliberate on the issue and give their opinion – the notice under section 4 itself should state that the land to be acquired would be developed as a farmers-government partnership or farmers – private partnership.   Thereafter, the proceedings under section –5A should be carried out by holding an open hearing by the competent authority in the village. That would provide an opportunity to place its collective views including the terms on which the land should be acquired.  The declaration issued under section-6 should specify the terms on which the land would be acquired.

 

The opportunity provided by section-9 can be utilized for placing the specific terms on which award should be based.  The declaration of award under section-11 can include those terms of settlement.Thus, procedurally, the conceptual formulation of land development as a partnership between the developing agency (public or private) and the farmers (including landless labourers) can be accommodated  within the existing legal frame and would not require  any amendment.

 

 

Hence, why can't farmer-government partnership be accepted when the future of coming generations of politicians, businessman, corporate is secured likewise even after land-use over generations the future of  farmers and their descendants  be secured too.

 

 

 

During the assembly which was presided by Smt Vedvati (the pillar of the Dharna in kanjhwala) and conveyed by Hans Raj Ghewada of khanjhwala village. The following opnions were shared:

 

 Mr Tevatiya from Tappal village of Aligarh highlighted the threat made to farmer leaders protesting in Aligarh against government's  land grab activities for the private industries.

 

 Dr Bhoop Singh Dalal of Bharat Bhumi Bacho Sangarsh samiti, Jajjar Haryana said "they are not in favour of giving away farmer lands and if land is necessary for the national interest amendments should be made in the Land Acquistion Act by including the concept of farmer-Government partnership in the Act".

 

Hans Raj Rana of Bhumi Bachao Kisan- Majdoor Taalmel Committee, Sonepat Haryana cited "whether it's a matter of saving farmers land or making amendments to the land acquisition act with the concept of farmer-Government partnership both requires struggle to be undertaken in a collective manner."

 

Marking the end of the meeting it was decided to make an alliance across NCR towards working jointly on the amendments in land acquisition act and including the farmer- government partnership in the Act, Members present including Smt Om Vati, Nirmala, Master Tarkar Singh from village Tikri Kala, Sangram Singh from village Ochandi village, Ram Bhal from Madapur-dabas, Randhir Singh from karala, Umrao Singh from Jonti village along with various others also presented their views.
